HIPAA Rule Change: Executive Order 14182

In January of this year our Record Retrieval Team communicated the that The United States Department of Health and Human Services (HHS), Office for Civil Rights’ (OCR) was putting into effect Rule 45 CFR Parts 160 and 164, which was established based on President Biden’s Executive Order 14076.

On January 24, 2025, President Trump signed Executive Order 14182, which revokes the previous Executive Order 14076. Based on this new Executive Order, HHS is now able to revoke Rule 45 CFR Parts 160 and 164, or make a new rule. Thus far, HHS has made no changes. For the time we are advising clients to continue using the Attestation Form when requesting records via subpoena. We will continue to actively monitor HHS for updates and alert you to any updates to the rules.
